Restrictions on use of materials

You acknowledge that this Site may contain information, communications, software, photos, text, video, graphics, music, sounds, images and other material and services (collectively, "Content") that is generally provided by SMART or by licensors of SMART. You agree and acknowledge that, notwithstanding that SMART permits access to the Content, the Content is protected by copyrights, trademarks and other proprietary (including intellectual property) rights (collectively, "Rights"), that these Rights are valid and protected in all media now existing or later developed, and that except as specifically provided in these Terms, your use of the Content shall be governed and constrained by applicable copyright, trademark and other intellectual property laws.

In addition to SMART's and its licensors' Rights in individual elements of the Content, SMART owns a copyright in the selection, coordination, arrangement and enhancement of the Content. You may not modify, publish, transmit, participate in the transfer or sale of, copy, reproduce, upload, create derivative works from, distribute, perform, display, incorporate into another website, or in any other way exploit any of the Content, in whole or in part, without the prior written consent of SMART, except that you may download one copy of the materials on a single computer for personal, noncommercial or educational use, provided that the material is not modified and that copyright, trademark and other proprietary notices are not deleted.

Patent notices

SMART's products, or portions thereof, are covered by various Canadian and U.S. patents. Additionally, patent applications are pending in several countries.

Unsolicited submissions

SMART welcomes comments regarding its products, programs and services. However, SMART's policy is not to accept or consider creative ideas, suggestions or materials other than those it has specifically requested or those in which you do not consider you have intellectual property rights. SMART hopes that you will understand that the intent of this policy is to avoid misunderstandings when projects developed by SMART's staff are similar to someone else's creative work. While SMART does value your feedback on its products, programs or services, SMART requests that you be specific in your comments on those products, programs or services and not submit creative ideas, suggestions or materials.

If, despite SMART's request that you not do so, you send us creative suggestions, ideas, notes, drawings, concepts or other information (collectively, "Unsolicited Information") the Unsolicited Information shall be deemed and shall remain the property of SMART. None of the Unsolicited Information shall be subject to any obligation of confidentiality on the part of SMART and SMART shall not be liable or owe any compensation for any use or disclosure of the Unsolicited Information.

This disclaimer shall apply to the fullest possible extent in jurisdictions that limit the exclusion of implied warranties.

In no event will SMART be liable to any party for any claim or damage, direct, indirect, special, consequential or otherwise arising out of the interpretation of, use of or reliance upon, authorized or unauthorized, this Site, the information contained on this Site, or any other hyperlinked site, including, without limitation, any lost profits, lost savings, business interruption, loss of programs or other data on your information handling system or otherwise, even if SMART is expressly advised of the possibility of such damages.
